For the purposes of commercial cannabis, California is a "dual licensing" state, meaning that a business owner must obtain a permit to operate a cannabis business first from its local municipality before receiving its state permit from one of the three regulatory agencies: BCC, CDFA, or CDPH. As a result, there are at least two—and in some cases, many more—sets of rules, regulations, and guidelines with which a cannabis-related business must comply.

California's cannabis legislation is constantly evolving, with over 60 bills going through the legislature in 2018 alone! The Emergency Regulations were updated several times and readopted prior to the Permanent Regulations, which are set to go into effect prior to the end of 2018. Thereafter, the "Permanent" Regulations will continue to go through a constant evolution. Therefore, establishing and constantly updating company SOPs for compliance are critical. Licenses at the local and state level require annual renewals, which are not guaranteed.
