Advisers in California for Cannabis Business Compliance

As a business owner, it can be very daunting to navigate the state and local government rules and regulations alone, especially in the complex cannabis industry. Like many cannabis business owners, you may envision focusing your efforts on building a successful company by providing quality products to customers. However, when you own and operate a licensed cannabis business in California, regulatory compliance must be among your highest priorities. At Green Wise Consulting (GWC), we help retailers, cultivators, manufacturers, distributors, and testing laboratories with all of their business and regulatory compliance needs.

A Complex System of Compliance

For the purposes of commercial cannabis, California is a "dual licensing" state, meaning that a business owner must obtain a permit to operate a cannabis business first from its local municipality before receiving its state permit from one of the three regulatory agencies: BCC, CDFA, or CDPH. As a result, there are at least two—and in some cases, many more—sets of rules, regulations, and guidelines with which a cannabis-related business must comply.

California's cannabis legislation is constantly evolving, with over 60 bills going through the legislature in 2018 alone! The Emergency Regulations were updated several times and readopted prior to the Permanent Regulations, which are set to go into effect prior to the end of 2018. Thereafter, the "Permanent" Regulations will continue to go through a constant evolution. Therefore, establishing and constantly updating company SOPs for compliance are critical. Licenses at the local and state level require annual renewals, which are not guaranteed.

Multi-Level Compliance Considerations

At GWC, our team has vast experience with the various regulatory agencies that manage the cannabis industry in California, including:

  • Bureau of Cannabis Control ("BCC"), responsible for licensing and compliance of Retailers (Storefront & Delivery), Testing Laboratories, Distributors, Microbusinesses, and Special Events.
  • California Department of Food and Agriculture ("CDFA"), responsible for licensing and compliance related to Cultivation, Nursery, and Processors.
  • California Department of Public Health ("CDPH"), responsible for licensing and compliance for cannabis-product manufacturers – Volatile, Non-Volatile, Infusion, Packager.

In addition, other regulatory entities such as the Department of Fish and Wildlife ("DFW"), the California Department of Taxes and Fees Administration ("CDTFA"), various Water Boards, and the California Natural Resources Agency with the California Environmental Quality Act ("CEQA") may also have input regarding your company's compliance.

We can also assist you in working with local authorities including city councils, boards of supervisors, city planning departments, police departments, fire fepartments, and zoning administrators. Maintaining compliance is a big job, but our consultants will provide the guidance you need.

Making Compliance a Habit

The most important way for you to keep your business compliant is to make compliance part of your day-to-day operations. GWC can help you set up compliant standard operating procedures ("SOPs") and plans so that every aspect of your company can be monitored at all times. With our assistance, your compliance team can oversee the establishment of compliant record-keeping practices, standard operating procedures, reporting processes, and regular audits.
